• Welcome to Atlas! We're delighted to have you join us on this out of the box journey. By using any part of our services or creating an account with Atlas, you agree to be bound by these Terms of Service. We encourage you to read these Terms carefully, as they set the foundation for our community. • At Atlas, we value your trust and strive to provide a safe and enjoyable experience. These Terms outline our commitment to you, so please take a moment to familiarize yourself with them. If you do not agree with these Terms, we understand, and we kindly ask that you refrain from using our services.

• Changes to these Terms of Services and Privacy Policy: We may update these Terms from time to time at our sole discretion. If we do, we will notify you by posting the updated Terms on the Atlas website and/or through other communications. It is important that you review the Terms whenever we update them or when you use the Services. If you continue to use the Services after we have posted the updated Terms, it means that you accept and agree to the changes. If you do not agree to be bound by the changes, you may not use the Services anymore. Because our Services are evolving over time, we may change or discontinue all or any part of the Services at any time and without notice, at our sole discretion.

 

1. Eligibility and account creation

• We've designed Atlas for adventurers aged 18 and above. By creating an account, you confirm that you meet this age requirement. Whether you're a Traveller seeking exciting experiences or a Content Creator sharing your journeys, we welcome you to join our community.

• To become a Creator, please apply through our app by selecting the option “Creator”. Becoming a Creator is an exciting opportunity, but it doesn't obligate us to feature your content on our platform. Our goal is to achieve the highest quality standards for itineraries, which requires us to collaborate closely to ensure we combine our strengths on the platform.

• If you're creating an account on behalf of a business, please ensure you have the authority to do so.

• When creating an account, please provide accurate and up-to-date information. You're responsible for all activities under your account, and we trust you to keep it secure.

• Remember, Atlas reserves the right to decline account registrations at our sole discretion, without the need for justification or compensation.

2. Interactions with other users

• One of the beauties of Atlas is the incredible community of creators. While interacting with fellow Users, you are in control, and we trust you to make meaningful connections. Atlas assumes no responsibility for these interactions. In the rare event of disputes, we encourage you to resolve them amicably. To the fullest extent permitted by law, you release us from any claims related to such disputes.

3. User conduct and content

Your contributions to Atlas, via content creation make our community vibrant. We trust you to create responsibly:

• You agree that you own or have the rights to share all User Content on our platform.

• You agree not to upload or post content that may create legal issues, contain explicit material, denigrate any group, disclose private information without consent, or spread harmful software like viruses.

Atlas may remove or delete User Content at our discretion, but rest assured, we're committed to maintaining a positive environment.

User Conduct: When using our services, you agree to:

• Use good judgment and follow our Community Guidelines.

• Not using our services in ways that violate the law or infringe on others' rights.

• Help us keep our services functioning smoothly by refraining from spam, harassment, unauthorized data collection, and security breaches.

By posting User Content on our platform, you grant us a license to use it as needed to provide Atlas services.

4. Fees and payments

• Pricing: You set your itinerary prices with a minimum of €30. You can adjust prices anytime via your creator account, but changes won’t apply retroactively.

• Revenue Share: Complying with our creator conditions, you’ll receive 80% of the amount paid by travellers for any sold itinerary, minus the prorata share of Apple fees, taxes, and payment processor fees. "Taxes" includes VAT and other governmental charges. Apple charges include a fee for in-app purchases. (Potential example below)

• Payments: To get paid by Atlas, you need an account with our payment processor. Their terms apply. Payments for your travel content will be made in Euros after each transaction via this account. Keep your payment details current and complete. 

• Atlas isn’t liable for payments on invalid transactions or illegal requests. We may withhold or chargeback payments in cases of fraud or breach of conditions.
  Reporting: Access payment reports via our payment processor.

• Taxes: You’re responsible for all applicable taxes on your payments, including any related penalties.

• No Circumvention: Process payments only through our specified method and payment processor. Don’t bypass our payment system or use alternatives like PayPal. Report any such solicitations to robin@atlasyourstory.com immediately.

• Ownership: You own your content but grant us a license to use it as per our Terms and Privacy Policy.​

5. Suggestions

• Your feedback and suggestions are invaluable to us! We want to hear your ideas, questions, and thoughts about Atlas and our services ("Suggestions"). When you share a suggestion, it becomes part of our collective journey. We appreciate your input, and there's no need to worry about confidentiality or compensation.

6. Platform Content

• While you explore Atlas, you'll encounter a world of content, from text and images to videos ("Platform Content"). All of this is here to enhance your experience and is protected under international copyright laws. Please respect the ownership of this content, and if you'd like to use it in any way beyond personal use, seek our permission first.

7. Copyright Policy

• Respecting intellectual property is crucial. If you believe your work has been used in a way that violates copyright, please reach out to us at robin@atlasyourstory.com. We'll work with you to address the issue promptly.

8. Hyperlinks

• Feel free to share our services with the world through hyperlinks, as long as you do so honestly and respectfully. We appreciate your enthusiasm for Atlas!

9. Third-party content

• Our platform may introduce you to content from other Users or third parties. Please keep in mind that we're not responsible for this content, and you should assess and manage any associated risks.

10. Termination

• We hope it never comes to this, but we reserve the right to terminate accounts or deactivate/delete them if they violate our Terms, policies, or community standards. We'll do our best to ensure a safe and enjoyable environment for all Users.

11. Discontinuance of services

• We're committed to continually improving Atlas. In doing so, we may make changes or updates to our services. We'll always strive to enhance your experience with us.

12. Governing law

• These Terms are governed by the laws of Belgium. Any disputes arising from these Terms will be exclusively handled by the Belgium courts.

13. Limitation of Liability

• To the fullest extent permitted by law, neither Atlas nor its service providers involved in creating, producing, or delivering the services will be liable for any incidental, special, exemplary, or consequential damages, or damages for lost profits, lost revenues, lost savings, lost business opportunities, loss of data or goodwill, service interruption, computer damage, system failure, or the cost of substitute services of any kind arising out of or in connection with these terms or from the use of or inability to use the services, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory, and whether or not Atlas or its service providers have been informed of the possibility of such damages, even if a limited remedy set forth herein is found to have failed of its essential purpose.

• To the maximum extent permitted by law, in no event will Atlas’s total liability arising out of or in connection with these terms or from the use of or inability to use the services exceed the amounts you have paid or are payable by you to Atlas in connection with the services, or one hundred dollars ($100) if you have not had any payment obligations to Atlas, as applicable.

• The exclusions and limitations of damages set forth above are fundamental elements of the basis of the bargain between Atlas and you.

• Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the limitations set forth above may not apply to you.

• Notwithstanding anything to the contrary in these terms, nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence or for fraud.

14. Reporting Misconduct

• If you encounter a User through our Services who you believe is behaving inappropriately, we encourage you to report this User to the relevant authorities and also notify us by emailing robin@atlasyourstory.com. Please understand that although we urge you to report such misconduct, we are not liable for the actions of our Users and are not obligated to take any action.

15. Indemnification

• You agree to indemnify and hold Atlas, its officers, directors, employees, agents, and any related parties harmless from and against any claims, disputes, demands, liabilities, damages, losses, costs, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with:

• (a) your access to or use of our Services; (b) any User Content or Suggestions you provide; (c) your violation of these Terms; (d) your violation of any rights of another; or (e) your conduct in connection with the Services.

• If you are using our Services on behalf of an entity, you represent and warrant that the entity agrees to indemnify you and Atlas for violations of these Terms in accordance with this Section. If you are obligated to indemnify us, we reserve the right, in our sole discretion, to control any action or proceeding and determine whether we wish to settle it, and if so, on what terms.

16. User’s Representations and Warranties

• By using the Services, you confirm that you have the full legal right and ability to agree to and fulfill these Terms. If you are using our Services on behalf of a business or organization, you confirm that you have the authority to accept these Terms for that entity.

• You also confirm that your use of the Services will be in accordance with all applicable local, national, and international laws and regulations.

• Moreover, you confirm that you will not use the Services if doing so is against the laws of your country, and that your use will not lead us to violate any legal regulations in your country.

17. Disclaimer of Warranties

• If you opt to use our Services, they are provided "as-is" without any warranties, including but not limited to guarantees of completeness, flawlessness, availability, or suitability for any purpose. We are not liable for any loss or damages related to the use of the Services, regardless of the type of legal claim. If you access or transmit any content through our Services, you assume all risks associated with such actions.
